Privacy Policy

1. Purpose and scope

Vertical AI Inc (“Vertical,” “we,” “us,” or “our”) respects your privacy and is committed to protecting your personal information. This Privacy Policy describes how we collect, use, disclose, and protect information about you in accordance with applicable United States federal and state privacy laws, including the California Consumer Privacy Act as amended by the California Privacy Rights Act (together, the “CCPA”), and the comprehensive consumer privacy laws of other U.S. states where they apply to us.

This Privacy Policy applies to our website at verticalinc.ai and to SocialSmith (socialsmith.ai) (together, the “Services”). Where a Vertical AI product publishes its own privacy policy, that product’s policy applies to it instead. For example, Morning Desk is covered by the policy at morningdesk.app/privacy.

Vertical AI Inc. is a United States company, and the Services are hosted on Google Cloud in the United States.

2. Consent

By using our Services, you consent to the collection, use, and disclosure of your personal information as described in this Privacy Policy.

3. Personal information

Personal information means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked with an individual or household.

Sensitive personal information includes account credentials and login information, including access tokens for social media accounts you connect to the Services, or other information defined as sensitive under applicable law. Vertical does not use or disclose sensitive personal information for purposes other than those permitted by law, and does not use it to infer characteristics about you.

4. Information we collect

We collect personal information through account registration, use of the Services, communications, billing and payment information, cookies, analytics tools, and the third-party social media accounts and integrations you connect to the Services. In the past 12 months we have collected the following categories:

  • Identifiers — name, email address, account username, IP address and device identifiers.
  • Commercial information — subscription plan, purchase and billing history. Payment card details are handled by our payment processor; we do not store full card numbers.
  • Internet or other electronic activity — how you use the Services, log data, browser type and pages viewed.
  • Connected account information — content, analytics, audience and engagement data made available by social media platforms you connect (see section 10).
  • User content — text, images, video, audio, brand materials and messages you submit or that we generate for you.
  • Inferences — content performance and audience insights we derive to provide recommendations.
  • Sensitive personal information — account credentials and connected-account access tokens.

We collect this information from you, automatically from your device, and from the third-party platforms you connect.

5. Use of information

We use personal information to provide and improve the Services, create and publish content on your behalf, generate analytics and recommendations, communicate with users, process payments, ensure security, comply with law, conduct analytics, operate artificial intelligence models, and for internal business purposes.

6. Disclosure

We may disclose personal information to service providers (including cloud hosting, analytics, AI processing, and payment processors), affiliates, legal authorities, and business successors as permitted by law. Our service providers are contractually limited to using personal information to provide services to us. We do not sell personal information. We may share limited personal information for analytics or cross-context behavioral advertising, which you may opt out of as described in section 9.

7. Cookies and analytics

We use cookies and similar technologies that are needed to sign you in and operate the Services. We use Vercel Web Analytics and Speed Insights, which do not use cookies, to count visits and measure page speed, and we may use analytics tools such as Google Analytics to understand how the Services are used. You may control cookies through your browser settings and opt out of Google Analytics via Google’s browser add-on.

8. Your privacy rights

If you are a California resident, you have the following rights under the CCPA. Residents of other states with comprehensive privacy laws have similar rights under their state’s law.

  • Right to Know (including the categories and specific pieces of personal information we hold)
  • Right to Delete
  • Right to Correct
  • Right to Data Portability
  • Right to Opt Out of Sale or Sharing, targeted advertising, and profiling in furtherance of decisions that produce legal or similarly significant effects
  • Right to Limit Use of Sensitive Personal Information
  • Right to Non-Discrimination for exercising these rights

To exercise these rights, contact privacy@verticalinc.ai. We will respond within 45 days, and may extend that once by a further 45 days where reasonably necessary, telling you why. We may verify your identity before processing requests. Authorized agents may submit requests with proof of authorization.

Appeals. If we decline to act on your request, you may appeal by emailing privacy@verticalinc.ai with the subject line “Privacy Appeal.” We will respond to your appeal in writing within the time required by your state’s law. If you are not satisfied, you may contact your state Attorney General.

9. Do Not Sell or Share My Personal Information

You may opt out of the sale or sharing of personal information, and of targeted advertising, by emailing privacy@verticalinc.ai with the subject line “Do Not Sell or Share.” We honor opt-out preference signals such as Global Privacy Control (GPC) as a valid opt-out request for the browser or device that sends them.

10. Connected social media accounts

To provide the Services, you may connect third-party social media accounts (such as Instagram, X, TikTok, Facebook, YouTube, LinkedIn, Threads, Pinterest, Reddit, and Google Business Profile). When you connect an account, we collect and store the access tokens provided through that platform’s authorization process, along with content, analytics, audience information, and engagement data the platform makes available to us on your behalf. We use this information solely to operate the Services you have requested — creating, scheduling, and publishing content, generating analytics, monitoring mentions, and providing recommendations. You may disconnect any social media account at any time, which revokes our access going forward. We do not sell this information.

YouTube and Google. When you connect a YouTube or other Google account, the Services use YouTube API Services. By doing so you agree to the YouTube Terms of Service, and Google’s handling of your data is governed by the Google Privacy Policy. You can revoke our access at any time from your Google account security settings. Our use and transfer of information received from Google APIs adheres to the Google API Services User Data Policy, including the Limited Use requirements.

11. Artificial intelligence processing

We use artificial intelligence services, including Google Cloud’s Vertex AI and Google’s Gemini models, to generate, analyze, and improve content within the Services. Content and related information you submit may be processed by these services to produce outputs. We apply contractual and technical safeguards with our AI providers, and we do not permit your content to be used to train third-party models except as disclosed to you.

12. Data retention and security

We retain personal information only as long as reasonably necessary for the purposes described in this Privacy Policy — generally for as long as your account is active and for a limited period afterward for backup, legal, tax, and dispute-resolution purposes — or as required by law. When you disconnect a social media account, we revoke our access at that platform and stop collecting data from it.

We apply reasonable technical and organizational safeguards. Data is stored on Google Cloud in the United States and is encrypted in transit and at rest.

Deleting your data. You can delete your account from your account settings, or request deletion of your personal information by emailing privacy@verticalinc.ai.

13. Children’s privacy

Our Services are intended for users aged 18 and over and are not directed to children. We do not knowingly collect personal information from children under 13 years of age. If we learn that we have, we will delete it.

14. Where your information is processed

Vertical AI Inc. is based in the United States and the Services are hosted in the United States. If you use the Services from outside the United States, your information will be transferred to, stored, and processed in the United States, where data protection laws may differ from those in your country. Some of our service providers may process information in other countries; where they do, we apply appropriate safeguards required by law.

15. De-identified data

We may use and disclose de-identified or aggregated data for analytics, research, product development, and business purposes. We maintain such data in de-identified form and do not attempt to re-identify it, except as permitted by law.

16. Changes

We may update this Privacy Policy periodically. We will post the updated policy here and update the “Last updated” date. If changes are material, we will provide additional notice as required by law. Continued use of the Services constitutes acceptance of updates.
